VineWood Estate Short-Term Rental Agreement
This Short-Term Rental Agreement outlines the rules, responsibilities, and risk acknowledgments for all guests staying at VineWood Estate.
1. Property & Occupancy
Property Address: 13141 Sagle Road, Purcellville, VA 20132.
Maximum Occupancy: Limited to 16 guests. Exceeding this limit may result in immediate termination of the rental without a refund.
Check-In/Check-Out: Check-in begins at 3:00 PM. Check-out is strictly by 11:00 AM to ensure professional cleaning of the 5,500 sq. ft. residence.
2. Vineyard & Property Rules
Vineyard Etiquette: Enjoy views of the 3-acre vineyard, but do not harvest, prune, or tamper with grapes or trellis systems.
Acreage Access: Guests may explore the nearly 10-acre property. Remain within marked boundaries and respect neighboring estates.
3. Pet Policy
Pet-Friendly Stay: Well-behaved dogs are welcome. A non-refundable pet fee of $225 applies per stay.
Guest Responsibility: Owners must clean up pet waste and supervise pets at all times to protect the home and grounds.
4. House Rules
Smoking: No smoking or vaping indoors.
Quiet Hours: 10:00 PM–8:00 AM on Friday and until 11:00 PM on Saturday.
Maintenance: Report maintenance issues or accidental damage immediately.
Release of Liability, Waiver of Claims, Express Assumption of Risk, & Indemnification Agreement
By completing a booking at VineWood Estate, the individual making the booking (the “Primary Guest”), on behalf of themselves and all other individuals staying at or visiting the property under this booking (collectively, “Guests”), agrees to the following legally binding terms:
1. Self-Guided Nature & Assumption of Risk (General Property)
VineWood Estate is a working vineyard and rural estate of nearly 10 acres with uneven terrain, wet or slippery surfaces, hidden obstacles, exposed stone edges, wildlife, insects, and variable weather. All activities are self-guided. Guests voluntarily accept and assume all risks of personal injury, death, or property damage related to these conditions.
2. Specific Assumption of Risk: Pool, Flagstone Deck, Hot Tubs, & Spa Amenities
The property includes a swimming pool, custom flagstone pool deck, outdoor stone walkways, two hot tubs, and a walkout Wellness Center and Spa (collectively, “Aquatic & Spa Amenities”). Guests understand and agree that:
- No lifeguard or attendant is on duty. Use is at Guests’ sole risk.
- Decking, walkways, and unsafe behavior: Flagstone and stone surfaces vary in texture and may be slippery when wet. Running, horseplay, diving, push-offs, jumping from elevated edges, or reckless behavior on or around wet surfaces is strictly prohibited.
- Health risks: Use of sauna, steam room, hot tubs, or cold plunge may pose significant health risks. Guests with medical conditions (including high blood pressure, heart conditions, diabetes, pregnancy) must consult a physician. Overexposure can cause dizziness, overheating, dehydration, or fainting.
- Safety rules: Obey all posted rules and capacity limits. No glassware on the flagstone deck or in wet areas.
3. Thermal Hazards: Stoves, Fireplaces, & Fire Pits
- Surface temperatures: The Austrian tile stove, fireplaces, and fire pits reach extremely high temperatures and retain heat after use. Contact can cause severe burns.
- Supervision: Guests are responsible for managing open flames and heat sources. Children must be kept away from these features at all times.
4. Stairs, Railings, & Child Safety Gates
- Stairs and railings: Handrails and guardrails provide balance support only. Use stairs with care. Sitting, climbing, swinging, leaning heavily on, or pulling against handrails or balcony pickets is strictly prohibited. Damage to structural fixtures will be billed to the Primary Guest.
- Child safety gates: Any provided gates are an optional courtesy, not warranted for fitness or defect-free performance. Assembly, installation, testing, positioning, and monitoring are the Guest’s sole responsibility.
5. Impairment & Substance Use Policy
Use of the Pool, Hot Tubs, Spa Amenities, fire pits, or stairs while under the influence of alcohol, drugs, or sedating medications is strongly discouraged. Guests choosing to do so accept full responsibility for resulting injury, death, or property damage.
6. Responsibility for Minors
Adults are solely and continuously responsible for the safety and supervision of minors. Children must never be left unattended near Aquatic & Spa Amenities, heat sources, or open stairways.
7. Comprehensive Release & Waiver of Liability
Guests, on behalf of themselves and their heirs, assigns, and personal representatives, fully release, waive, discharge, and covenant not to sue the owners of VineWood Estate, their members, managers, employees, and agents for any and all claims arising from loss, damage, injury, or death occurring during the stay, whether caused by the negligence (active or passive) of such parties or otherwise.
8. Indemnification & Hold Harmless
The Primary Guest agrees to indemnify, defend, and hold harmless the VineWood Parties from any and all claims, damages, costs, and expenses (including reasonable attorney’s fees) made by or on behalf of any member of their party (including minors) or any visiting guest for injury, death, or property damage occurring at the property. The Primary Guest is responsible for all defense costs and judgments if any such claim is filed.
